5. Our lawful bases for processing

Under UK data protection law, we rely on different lawful bases depending on why we are using your information.

These may include:

Legitimate interests – where processing is reasonably necessary to operate our recruitment business, identify suitable candidates, develop professional relationships and provide recruitment services, provided those interests are not overridden by your rights.

Contract – where processing is necessary to take steps at your request or to fulfil an agreement with you.

Legal obligation – where we are required to process information in order to comply with applicable law.

Consent – where consent is the appropriate legal basis, including in certain circumstances involving sensitive information or particular forms of marketing.

Where we rely on consent, you can withdraw that consent at any time.

6. Candidates identified by Fourteen Search

You do not need to have applied for a vacancy for us to hold limited professional information about you.

We may identify individuals whose professional backgrounds appear relevant to our clients or specialist markets.

Where we obtain your personal information from another source, we will handle it in accordance with applicable data protection requirements and provide appropriate privacy information.

7. Sharing your information

We may share personal information where appropriate with:

  • clients and prospective employers;
  • technology providers used to operate our business;
  • CRM and recruitment software providers;
  • email, communications and cloud-service providers;
  • professional advisers such as accountants, lawyers and insurers;
  • regulatory or governmental authorities where legally required.

We only share information where there is an appropriate reason for doing so.

Candidate information will not ordinarily be provided to a client as an active candidate submission without the candidate being aware of the relevant opportunity.

8. International transfers

Fourteen Search works internationally, including with organisations and candidates in the United Kingdom, Europe and the United States.

This means personal information may sometimes be transferred outside the United Kingdom.

Where required, we will use appropriate safeguards for international transfers in accordance with applicable data protection law. These may include recognised adequacy arrangements, contractual safeguards or other lawful transfer mechanisms.

9. How long we keep information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including recruitment, relationship management and legal or regulatory requirements.

For candidate information, we would normally review whether information remains relevant periodically and may retain professional recruitment records for up to 24 months following our last meaningful interaction, unless there is a legitimate reason to retain them for longer or you ask us to delete them.

Certain contractual, financial or legal records may need to be retained for longer periods.

10. Keeping information secure

We take reasonable technical and organisational measures to protect personal information against unauthorised access, alteration, disclosure or loss.

Access to personal information is limited to people and service providers who reasonably require it for legitimate business purposes.

11. Your rights

Depending on the circumstances, you may have rights to:

  • request access to personal information we hold about you;
  • ask us to correct inaccurate information;
  • request deletion of your information;
  • restrict how we use your information;
  • object to certain processing;
